Man Arrested After Failing To Appear In Court

WARSAW — A man sentenced in a 2012 case of intimidation was arrested Tuesday after he failed to appear for a court hearing on Aug. 17. The court hearing related to a probation violation on July 13.

Booking reports show Bruce R. Miller, 54, 5076 W. Lakeview Park Drive, Warsaw, was arrested Monday on three counts of intimidation, all class D felonies. He is being held on no bond. However, according to the prosecutor’s office the arrest stemmed from a failure to appear charge.

The original case was a dispute over an individual allowing his dogs to run loose, threatened to shoot his neighbors and reportedly did shoot one dog.

Court documents, filed May 17, 2012, state Miller told police his neighbors complained about his dog running loose and he took his .22 caliber rifle and began shooting at the dog, which at that time was across the street. Neighbors called the police and Kosciusko County Sheriff’s Deputy Nicholas Spangle, arrived at the scene.

Spangle first spoke with Christopher Hale, who described the situation and said he had left and heard a shot. Spangle was later called back to Miller’s residence, where he again spoke with Hale. He learned the dispute allegedly erupted when Hale, along with neighbors Jesse Hite and Kenneth Rice, had confronted Miller, whose dog had killed one of Rice’s chickens. At that time, Miller had threatened to shoot all three of them.
